The CEMEX decision was a landmark NLRB case decided earlier this year as a result of that employer’s egregiously unlawful behavior during an election the workers had to join the Teamsters. It imposed a new policy whereby all employers will now be required to bargain with a union if the employer commits labor law violations that compromise the legitimacy of an election’s outcome. Previously, the remedy was to order a re-run election.
